50% stamp duty折扣的问题......问题解决 - 肯定可以折扣

我刚问一个loan agreement的律师, 第一次买屋又不超過350千是否有stamp duty 50%折扣, 她说没有, 只是S&P有折扣...是否真的如此?

查看一些网站和论坛, 有人说没有折扣, 有人说有...不懂哪个才是正确的...

没有错的话是SPA的stamp duty才有五十巴仙的。loan agreement的stamp duty才loan amount的0.5%左右,影响不大吧。SPA那边的就厉害贵了。

网上有些人说有, 有些人说没有....所以我先要搞清楚....虽然stamp duty只是0.5%, 50%折扣的话只是0.25%, 但也已经是几百块了...如果应该得到政府的折扣的话,没有理由白白给多政府吧?

没有错的话loan agreement 50% exemption on stamp duty只是给PR1MA的买家而已的。

好像不管PR1MA不PR1MA,都有exemption。

看42页。搞到我现在一头烟。不过我的超过350k一点点,折扣无望。

Stamp Duty for S&P/SPA

Current

Stamp Duty for purchase of residential property not exceeding RM250,000 are given stamp duty exemption of 50%, The exemption is granted on one residential property for each individual Malaysian citizen. The exemption is effective for S&P/SPA executed from 8 September 2007 to 31 December 2010.

Proposed in Budget 2011

    * 50% stamp duty exemption will be given on S&P/SPA with residential property price not exceeding RM350,000.
    * The exemption is granted on the first residential property purchased by Malaysian citizen and eligible to be claimed once only within the exemption period.
    * Eligible for S&P/SPA executed from 1 January 2011 to 31 December 2012.

Loan Agreement

Current

Stamp duty rate on loan agreement for purchase of residential property is at 0.5% of the loan value. Loan agreement for residential property priced not exceeding RM250,000 are givent stamp duty exemption of 50%. The exemption is granted for the purchase of one residential property for each individual Malaysia citizen. The exemption is effective for S&P/SPA executed from 30 August 2008 to 31 December 2010.

Proposed in Budget 2011

    * 50% stamp duty exemption will be given on loan agreement with residential property price not exceeding RM350,000.
    * Eligible for loan agreements made between purchase with the bank, financial instituions, insurance companies, cooperatives or employer under the employer housing loan scheme.
    * The exemption is granted on the first residential property purchased by Malaysian citizen and eligible to be claimed once only within the exemption period.
    * Eligible for S&P/SPA executed from 1 January 2011 to 31 December 2012.

你已经买了吗?

如果只是超出一点, 可以问律师, 有办法降低到350千的...我的就是如此做的...不过我是买二手屋的啦..新屋就不能

我的是新的,买了也什么都签完了。但是loan agreement不是应该跟借贷的数目吗?如果跟借贷数目的话我的少过350K。但是已经给了,你已经给了的吗?

新的就没办法。。。不过新买的,起好就有溢价了吧。。。少少的税务损失没什么的。。

根据上面写的。。有没有discount,是跟着买价的。。我还没给,现在刚签了SNP要申请贷款

我有一个问题,这50%是给第一次买屋的人罢了,对吗?
假如两个人联名,一个不是第一次置业,但另一个第一次置业,还享有这个折扣吗??

The 50% stamp duty remission for adjudication of sale & purchase transaction of 1st time purchaser for property below RM350K takes effect from 01.01.2011 until 30.12.2012 via a Stamp Duty order (Remittance) No.3 2010 as of 03.12.2010. The stamp duty remittance is on the adjudication of sale & purchase agreement, not on bank legal charge. Therefore, the stamp duty payable on the legal charge applies as usual.

First-time Malaysian citizen house buyers will be given stamp duty exemption of 50% on (1) instruments of transfer (i.e sale and purchase agreement) and (2) loan agreement on a residential house price not exceeding RM350,000 during 1 Jan 2011 to 31 Dec 2012. Residential property include a terrace house, condominium, apartment or flat. Question here is – would serviced apartments erected on commercial land be scope out? Clarifications need to be sought from IRB.

大大们, 想借问、我买的家是rm234k 那么我的stamp duty fee 是改多少?我的lawyer charge me rm3680. 救救咯!楼主,借用下。谢谢。

买价RM234,000,头一百千要给1%税就等于RM1,000,接下来的给2%税就等于RM2,680,加起来就RM3,680。

我买的时候连loan agreement的stamp duty都有50% 折扣的喔
