POLICE AND YOUR BASIC RIGHTS

1. POLICE STOPS YOU 当警察停你时。
1.1 Not in uniform, ask for identification 警察没穿制服， 公众可问对方身份证明。
Say: "Please, show me your Police authority card". 说： 请让我看你的 police card.
1.2 Police authority card 警察的 police card
Red : Suspended Police Officer. He has no authority to do
anything to you. Walk away. 如果是红色， 他是已被革职了的警察，没权力查你可走开。
Other colours: 其它颜色。
• Blue : Rank of Inspector and above 蓝色： inspector 或以上职位。
• Yellow : Below the rank of Inspector 黄色： inspector 以下的职位。
• White : Reserve police 白色： 后备警察
Note his name and ID number 写下他的名字和 id number
1.3 In uniform 制服
Note his name and ID number on his uniform. 写下他制服上的名字和 id number.
1.4 Police vehicle 警察的交通工具
Note the number plate of the patrol car or motorcycle. 写下他的车牌。
2. POLICE QUESTION YOU WHEN STOPPED 警察查问你时。
2.1 Your identification 你的身份
Only give your name, ID card number and address. 只需给你的名字， ic 号码和地址。
2.2 The police ask other questions 警察问其它问题。
Politely ask "Am I under arrest?" 礼貌地回问他： 我是不是要被扣留了？
2.3 When you are under arrest 如果你是被扣留。
You are arrested if the police: 你肯定是被扣留如果警察回答说：
• tells you "yes"; 是的。
• does not allow you to leave/want to take you to the Police
Station; or 不让你离开， 或要把你带去警局
• handcuffs you 用手铐 扣着你。
if you are not under arrest, you may walk away/refuse to follow
him back to the Police station or anywhere else, if asked. 如果你没被扣留， 你可走开或不需要跟他去警局。
2.4 When you cannot be arrested 什么情况下 你不能被扣留。
The police cannot arrest you just because you are a potential
witness and want to take a statement from you (112 / Witness
Statement). 警察不能随意扣留你和要和你拿口供 就只因为你可能是个 人证
3. QUESTIONING BY POLICE WITHOUT ARREST 没被警察扣留时的问话。
3.1 112 Statement
When the police are investigating a case and think you have
information / knowledge about the case, the police may examine
you and take down your answers (112 Statement). 当警察真在调查某个案件时，如果他觉的你有相关案件的资料，警察就会问话你和拿下你的口供。
3.2 Informal/Formal Request 正式或非正式的要求。
Most times, the police make an informal request that you give a 112
Statement. If the place and time is convenient to you, cooperate.很多时候， 警察会在非正式的
情况下要求你给口供 。 如果地点和时间对你是方便的， 你可和他们合作。
If not, tell the police you will do so at a convenient place. 如果不方便，告诉那警察，可换去比较方便的地方进行。
If you refuse to cooperate, the police may issue a formal order in
writing, signed by an investigating officer (Police Officer) to ask
you to cooperate.
如果你拒绝合作， 警察可用书写方式出正式要求， 由调察官员签名（警察） 要求你
合作。如果你不遵从这个 警察指示police order , 你还是不能被扣留的。 但是， 这是一项
违法， 警方会到地庭要求推事强硬执行有关逮捕令.
3.3 Giving a 112 Statement 给 112 口供
You have the right to ask a lawyer to accompany you.
This is advisable. 你有权力要求以个律师陪你，最好社这样做。
In giving a 112 Statement, you may refuse to answer any question /
remain silent if the answer is likely to expose you to a criminal
offence. 真在给 112口供时， 你可以拒绝答复或保持安静， 如果你要给的回复可能会让你犯上刑事罪。
• Bring along a notebook or writing paper with you (Personal Notes). 带一个纸或笔记。
• Write down every question asked in your Personal Notes. 写下所有问你的问题。
• Make sure you understand every question asked. 却定你明白所有被问的问题。
• Take your time and think carefully before writing your answers in
your Personal Notes. 别急， 慢慢的去想然后才把答案写在那笔记上。
• Read your answers to the Police Officer questioning you. 读出那答案个那个问你的警察听。
• Keep your Personal Notes for future reference 收着这笔记以后参考
3.4 Signing your 112 Statement 签 112 口供文件
Before signing your Statement, read the questions and your answers
written by the Police Officer carefully. 还没签之前， 要读好 那警察所写下的 问题和你给的答案。
• Compare the Statement you are asked to sign with your Personal
Notes. 比较你被要求去签的和你自己个人的笔记。
• You have the right to make any corrections/changes to the
Statement before signing. 还没签之前， 你有权力作任何更改。
• Sign your signature immediately below the last sentence of your
Statement. 在你写的最后一个句子下面签名。
4. POLICE ARREST YOU 当警察扣留你
4.1 Ask: "Why am I under arrest?" 问警察： 为什么我被扣留？
An arrest is unlawful if you are not informed of the reason. 如果你没被告诉被扣留的原因， 这个扣留是不合法的。
4.2 Do not resist an arrest 不要用力去反抗
The Police have the right to use reasonable force to arrest you if you
resist. 警察有权力用 适当的武力去扣留你，如果你要反抗的话。
4.3 Ask: "Which Police station are you taking me to?" 问那警察： 你要把我带去那个警察局？
The arresting Police Officer must immediately take you to the
nearest Police station and no other place. 扣留你的那个警察以定会立刻把你带去最近的警察局 而不是其它地方。
4.4 What to do when arrested 如果被扣留，要做什么
You have the right to telephone call to:- 你有权利 打电话给：
1. Your relative or friend; and 家人或朋友
2. A lawyer. 一个律师
You may also call a nearby Legal Aid Centre (LAC). Inform them: 你也可以打电话给法律援助中心 lac.告诉他们：
• you have been arrested; 你被扣留了。
• the time, place and reason of the arrest; 时间， 地点和扣留原因
• the Police station you will be taken to. 被带去的警察局

4.5 What happens after arrest 扣留后会发生什么事
You may be detained up to 24 hours: 你可能被扣留最多到 24小时
• at the Police station, or 在警察局，或
• in a lock-up to "assist" police investigation 在扣留所 “协助”警察调查。
5. YOUR RIGHTS AFTER ARREST & DURING DETENTION 你被捉 & 被扣留时的你的个人权力
5.1 Right to consult a lawyer 有权力找律师
Once you request for the presence of a lawyer, you have a right to

5.2 Clothing 衣服
You are allowed to have one set of clothing with you in the
lock-up. 在扣留所里你可以有一套你的衣服。
5.3 Personal belongings 个人物件
The Police must record and put all your personal belongings in
safe custody. Your personal belongings must be returned to you
upon your release. 警察一定要记下你所有的个人物件， 全不要放进保险箱。你出去时以定要权不给会你。
5.4 Welfare 福利
You are allowed to take a bath two times a day. If you are sick,
you have the right to receive immediate medical attention.
You are to be given proper and adequate food and water during
detention. 你可以一天冲凉2次。如果你生病，你有权力立刻要求医药服务，在扣留期间会被给足够的水和食物。
5.5 How long may the Police detain you 警察可以扣留你多久
The Police may only detain you up to 24 hours for investigation.
The duty of the Police is to complete investigations within 24 hours
and to release you as soon as possible. If the Police cannot complete
investigations within 24 hours, the Police must bring you before a
Magistrate for a remand order to extend your detention beyond
24 hours (Remand Order). 警察可扣留你至到 24 小时。警察的任务是在这24小时里完成调查和放人。
如果警察不能在24小时内完成，警察一定要带你去地庭（法庭） 要求延长超过24小时。
