Key Limitations on Union Roles
Restricted Membership: The law prohibits general or national omnibus unions. Workers can only join or form unions that represent their exact same or similar industry, trade, or occupation.
Enterprise-Only Constraints: In-house or enterprise unions are largely restricted to just the specific company you work for, meaning you cannot easily collaborate with employees from sister companies or subsidiaries.
Exclusion of Key Personnel: Employees holding managerial, executive, confidential, or security positions are legally barred from joining or forming trade unions.
Strict Limits on Industrial Action: Organizing strikes is heavily regulated and often requires complicated balloting procedures. Furthermore, unions are generally forbidden from engaging in political activities.
Allowed Roles & Responsibilities
Despite these hurdles, recognized trade unions still legally fulfill essential functions for the Malaysian workforce:
Collective Bargaining: They are the only legally recognized bodies permitted to negotiate and submit a proposal for a legally binding Collective Agreement (CA) covering salary scales, allowances, working hours, and leave entitlements.
Dispute Resolution: They represent members in trade disputes, mediation, and appeals regarding unfair or unjustifiable dismissals before the Industrial Court.
Welfare & Advocacy: They act as a collective voice to air grievances, promote worker safety, and lobby for better employment practices within the National Labor Advisory Council |
