现在的店屋租约合同这样写对吗?关税局盖印STAMPING要多少钱?

Provided always and it is expressly agreed as follows :-

a)        i) If the rent shall be unpaid for  seven (7) days after the same becomes payable (whether demanded or not) , or

ii) any covenant on the Tenant’s part herein contained shall not be performed or observed, or

iii) if the Tenant shall have a receiving order made against him or shall have made any assignment for the benefit of his creditors, or

iv) enters into any agreement or any arrangements with his creditor by composition or otherwise or

v) suffer any distress or attachment or execution to be levied against his goods, or

vi) if the Tenant for the time being shall be a company and shall go into liquidation whether compulsory or otherwise except for the purpose of reconstruction or amalgamation, then


and in any such cases it shall be lawful for the Landlord at any time thereafter to re-enter and repossess the Demised Premises and this Tenancy  shall absolutely terminated, but without prejudice to the right of action of the Landlord in respect of any breach of the covenants herein contained and further the Landlord shall be entitled to forfeit the Security Deposit now paid AND it is expressly agreed and confirmed by the Tenants that in such circumstances arising the Landlord and/or its agents or servants are expressly authorized by the Tenant to use reasonable force as is necessary in the exercise of the Landlord’s right herein without liability for any damage caused to the Tenant’s property as a result thereto.


b)        If the Demised Premises or any part thereof shall be destroyed by fire so as to be unfit for use, then the rent hereby covenanted to be paid or a fair proportion thereof according to the nature and extent of the damage sustained shall be suspended until the Demised Premises shall again be rendered fit for habitation and use and any dispute concerning this clause shall be determined by a single arbitrator in accordance with the provisions of the Arbitration Act 1952 (Revised 1972) or any statutory enactment in that behalf for the time being in force and provided always that nothing herein shall render it obligatory for the Landlord to restore, reinstate or rebuilt the Demised Premises or any part thereof if the Landlord in its absolute discretion does not desire to do so in which event either party shall be entitled to terminate this Agreement by one (1) day notice in writing and upon such termination neither party shall have any claim against the other save and except in respect of any antecedent breach.


c)        The Landlord shall at the written request of the Tenant made not less than three (3) months before the expiration of the term hereby created and if there shall not at the time of such request be any existing breach or non-observance of any of the covenants of the part of the Tenant herein contained to be performed at the Tenant’s expense grant to the Tenant a tenancy of the Demised Premises for a further term and subject to the conditions stipulated in Schedule I.

7.        Any notice or other documents in writing required to be served delivered or given hereunder shall be sufficiently served if left addressed to the Tenant on the Demised Premises or sent to the Tenant by registered post addressed to the Tenant’s last known address in Malaysia and any notice document or writing to the Landlord shall be sufficiently served if sent by registered post to the Landlord’s last known address.

8.        All cost of and incidentals to the preparation and execution of this Agreement including government stamp duty shall be paid by the Tenant.

9.        It is hereby expressly agreed between the Landlord and the Tenant that the tenancy of the Demised Premises shall be in addition to the terms and conditions herein be subjected to the Special Conditions, if any, set out in Schedule K. In the event of any conflict, discrepancies or variance, the Special Conditions shall prevail.

10.        The Schedules and the Special Conditions shall be taken, read and construed as an integral part of this Agreement.

11.        Time wherever mentioned shall be of the essence.

12.        This Agreement shall be binding upon the successors-in-title and assigns personal representatives and heirs of the Landlord and the Tenant.
