9. TERMINATION
a) Whilst on probation, this appointment may be terminated without giving any reason by either party with two (2) weeks’ notice in writing or the payment of a sum equivalent to two (2) weeks’ notice salary in lieu of notice.
b) After confirmation, either party may terminate this appointment by giving one (1) month’s notice in writing or the payment of a sum equivalent to one (1) month’s salary in lieu of notice.
c) Upon termination of this appointment, you will not be allowed to take leave or use your unconsumed earned annual leave to offset against the period of resignation notice unless with Company's approval based on exigency of service.
d) Upon termination of this appointment, all staff benefits will cease and all monies due and owing to the Company must be repaid to the Company. The Company reserves the right to set off any sum from the monies payable by the Company to you on termination.
e) The Company reserves the right to terminate your employment without notice and without compensation in the event of misconduct inconsistent with the fulfilment of the expressed or implied conditions of your appointment, or any breach of the terms and conditions of this agreement.
