关于offer letter.. 想请教大家一下

大家好，小弟看中一间屋子，谈妥了价钱，明天打算和屋主签offer letter和给booking，过后才去银行申请loan

以下是我朋友给我的offer letter.. 但如果我想加如果loan reject了，booking fee必需100%refund

请问如何写比较好？谢谢大家

Purchase Price: Ringgit Malaysia ____________________________________________

Payment Terms:

i)      (10%) of the Purchase Price to be paid upon signing ofSales and Purchase Agreement (S&P)

ii)     Balance ninety percent (90%) of Purchase Price to bepaid within 3 months from date of S&P or date of receipt of consent ofrelevant authorities

I / We hereby to undertake to execute the S&P within 30days (“Said Period”) from the date of acceptance of this offer by the owner, failingwhich the Earnest Deposit shall be forfeited.

Thereinafter this agreement shallbe terminated and be null and void and neither party shall have any rights overthe other party thereafter.

In the event the Vendor fails to execute the S&P withinthe Said Period, the Vendor shall refund the Earnest Deposit.

你只是写Reject而已是不够的，如果银行借你80%，这样是不是你可以接受的。 如果不可以，你应该写如果Loan批底过90%,booking fee要全数退还。。

booking form那里有没有一个是subject matter? 有的话，你就注明subject to 90% loan approval，还有，看清楚它给你是多少天的period，14days? 21 days? 14 working days?

有很大差别哦，不要随便签哦

booking form是我自己准备的，直接对屋主，屋主也接受，只是英文不会写罢了

subject to 90% loan approval。。。。。。。。。。。。。。。。。

明天给booking fees开cheque是给屋主的名字吗？如果屋主是狡猾的到时就会很麻烦了，有agreement都没用。如果没有agent最好就是找律师质询再给booking fees吧。
