Facts: When Mabel Ruth Budd died, she bequeathed her home to her husband, George. There was a mortgage on the home and George asked the court to rule that the estate pay the mortgage so he would get the property freed of it. There was no statute covering this question.

Outcome: The court looked to the state constitution that said the common law continued as a part of state law. Because the common law was that a person willed real estate had aright to have a mortgage paid, George got the property freed of the mortgage.
