[中馬] 如果租户到期不Renew,屋主可以做些什么?(寻求产业高手意见)
“If this Tenancy is not renewed upon its expiration, and the Tenant still remains in possession of the Premises with the Landlord’s written consent and upon such additional terms and conditions as the Landlord shall impose, the Tenant shall be deemed a Monthly Tenant only. The rental for such a Monthly Tenancy shall bepaid monthly in a advance.”
以上是从Tenancy Agreement里的clause。
现在情况是这样,过了Tenancy Agreement Expire date,租户一直给这原本的租金,屋主也照收并有出Receipt。
过多三个月租户要搬了,给了屋主notice period一个月要般,屋主没有问题。但是要拆招牌需要多一个星期,屋主也答应,全部deposit可以给回。但是过后屋主反口要扣多一个月租金,因为多出一个星期。争执下屋主拿回这个Monthly Tenant 的clause来说,当时他们可以double up我们的Rental,甚至十倍也可以,决定硬要扣一个月。
